These Terms & Conditions (“Terms”) govern your access to and use of the website at pimofydigital.com and the services provided by Pimofy Digital (“Pimofy”, “we”, “us”, or “our”). By accessing this website or engaging our services, you agree to these Terms. If you do not agree, please do not use the website or our services.

1. About Us

2. Services

We provide dedicated data operations services, including data entry and verification, CRM updates, data enrichment, research, database cleanup, back-office operations, and non-voice customer support, delivered through our Dedicated Data Operations Pod™. The specific scope, deliverables, quality standards, and pricing for any engagement are set out in a separate proposal or service agreement agreed between you and Pimofy. Where those documents conflict with these Terms, the signed service agreement takes precedence.

3. Engagement, Fees & Payment

Engagements typically include a one-time setup fee and a recurring monthly fee per dedicated specialist, as quoted in your proposal. Unless otherwise agreed in writing, fees are invoiced in advance, are exclusive of any applicable taxes, and are payable by the date stated on the invoice. A complimentary trial period may be offered and, where applicable, is deducted from your first month’s invoice.

4. Quality Standards & Remedies

Agreed quality standards, turnaround times, and KPIs are documented during onboarding. If agreed standards are not met due to our performance, we will, at no additional cost, provide additional training to the assigned specialist or replace the specialist, and re-perform the affected work. Where errors arise from inputs outside our control (for example, inaccurate source data or unclear instructions), we will flag the issue and correct it within the agreed monthly capacity, quoting transparently for any work that exceeds that capacity.

5. Client Responsibilities

You agree to provide accurate information, timely access to the systems and materials needed to perform the services, and clear instructions. You are responsible for ensuring you have the right to share any data you provide to us and for maintaining your own backups of critical data.

6. Confidentiality

We treat your information as confidential and will operate under your confidentiality and non-disclosure (NDA) requirements. We will not disclose your confidential information except as required to perform the services or by law.

7. Term & Cancellation

Unless otherwise agreed, engagements run on a month-to-month basis after the initial setup, with no long-term lock-in. Either party may end the engagement by giving the notice period stated in the service agreement. Fees already paid for the current period are non-refundable except where required by law.

8. Intellectual Property

All content on this website, including text, graphics, logos, and the Pimofy name and marks, is owned by or licensed to Pimofy and may not be reproduced without our permission. Work product created specifically for you as part of a paid engagement belongs to you upon full payment, as set out in your service agreement.

9. Limitation of Liability

To the fullest extent permitted by law, Pimofy will not be liable for any indirect, incidental, or consequential loss, or loss of profits, revenue, or data. Our total liability arising from any engagement will not exceed the fees paid by you to Pimofy for the services in the three months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.

This website may contain links to third-party websites or services that we do not control. We are not responsible for the content or practices of those third parties.

11. Changes to These Terms

We may update these Terms from time to time. The version published on this page, with its “last updated” date, is the version in effect. Continued use of the website or services after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of Kenya, and the courts of Kenya will have jurisdiction, without affecting any mandatory consumer protections available to you in your country of residence.
